The present criminal miscellaneous application has been filed by the applicant for quashing the impugned part of the order dated 06.10.2016 passed by the Sessions Judge, Dehradun in Criminal Appeal No. 141 of 2016, “Bihari Lal Vs. Smt. Ram Pyari Devi”, reducing the interim maintenance from 5,000/per month granted by the learned III, Additional Civil Judge (Junior Division)/ Judicial Magistrate, Dehardun vide order dated 09.09.2016, under Section 23(2) of the Protection of Women from Domestic Violence Act to 2500/- per month.
Learned counsel for the applicant submitted that the criminal miscellaneous application has rendered infructuous.
In view of the statement of learned counsel for the applicant, the criminal miscellaneous application is dismissed as infructuous.
