Applicant Brijnath Paswan @ Vikky seeks bail in connection with Case Crime No./FIR No. 319 of 2015, under Sections 420, 467, 468, 471 and 120-B of IPC, Police Station Patel Nagar, District Dehradun. Heard learned counsel for the parties and considered the grounds taken up in the bail application.

The applicant, who is in jail since 25.10.2015, is alleged to be a gang of cheaters, who lured the people for providing employment to them in the Railway Department and collected money from unemployed youths in lieu thereof. All the appointment letters and metical certificates issued to the aspirants were forged and fabricated. In the bail rejection order dated 05.04.2016. It has been mentioned that the co-accused Vijay Prakash @ Shyam Prakash has been granted bail by this Court vide order dated 25.11.2016.

Considering the fact that the co-accused has been granted bail by this Court and the applicant is in jail since 25.10.2015, and has no previous criminal history, this Court is of the opinion that the applicant should be granted bail.

Let the applicant be enlarged on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the Magistrate concerned.

If at any point of time, it is found that the applicant is misusing the bail, learned court below shall be at liberty to cancel his bail in accordance with law.
