Applicant Andaz alias Boby seeks bail in connection with case crime no. 79 of 2014, under Sections 395, 412 IPC, registered at Police Station, Kankhal, District Haridwar.
Heard learned counsel for the parties, considered the grounds taken in the bail application and perused the documents on record.
An FIR was lodged against four unknown miscreants for the offence punishable under Section 392 IPC on 24.05.2014, at police station, Kankhal, alleging therein that the unknown accused persons trespassed into the house of the informant and took away valuable from his house. Some of the incriminating articles were allegedly recovered from the possession of the applicant. No Test Identification Parade has been conducted so far. Accused-applicant is not a previous convict and he is in jail since 05.06.2014.
Considering the above facts and circumstances, a case for bail is made out in favour of the present applicant.
Bail application is allowed. Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties, each of like amount to the satisfaction of the Magistrate concerned.
If at any point of time it is found that the applicant is misusing the bail, the court below shall be at liberty to cancel the bail after affording reasonable opportunity of hearing to the applicant.
