Applicant Rajkumar, who is in jail in connection with Case Crime No. 14 of 2015, under Section 386 of IPC, PS Patel Nagar, District Dehradun, has sought his release on bail.
Heard learned counsel for the parties, perused the documents on record and considered the grounds taken in the bail application.
Allegedly a threatening letter was given by the accused persons to the complainant demanding a ransom of Rs. 50 lacs or else complainant’s son would be killed. Both the complainant as well as the applicant run brick kiln business. The applicant is in jail since 15.01.2015 and has no previous criminal history. Neither the ransom was paid nor son of the complainant was abducted. Report of the Forensic Science Laboratory is yet to come.
Considering the facts and attenuating circumstances, a case of bail is made out in favour of the applicant.
Accordingly, let the applicant be enlarged on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the Chief Judicial Magistrate, Dehradun.
