Mr. S.S. Yadav, Advocate, present for the respondent nos. 4 & 6. Petitioner has filed this writ petition primarily challenging the lease deed granted to private individual. His assertion is that the lease was actually granted for public purpose i.e. for opening a library and now it is being used for other purposes.
The lease was granted, on behalf of His Excellency the Governor, by the District Magistrate, Nainital. We presently see no purpose to interfere in this matter.
In case, the petitioner feels that there is some anomaly committed, which is in violation of the lease he is always at liberty to approach the District Magistrate, Nainital.
The writ petition is disposed of with the direction to the District Magistrate, Nainital that in case, such an application is made by the petitioner, it shall be decided in accordance with law.
No order as to costs.
