Mr. Nagesh Aggarwal, learned counsel for the petitioner, in view of the judgment passed by this Court in the case of Harsh Kapoor and others vs. Smt. Komal Kapoor in Criminal Misc. Application No. 842 of 2013 decided on 21.08.2013, seeks permission to withdraw this petition with liberty to file criminal revision before the Session Judge. He, however, submits that revision shall be preferred within four weeks from today, therefore, same may not be dismissed on the ground of limitation.
Permitted to be withdrawn with the aforesaid liberty.
However, it is made clear that if revision is filed within four weeks from today, same shall not be dismissed on the ground of limitation and shall be decided by the learned Session Judge at its own merit in accordance with law.
CRMA No. 1592 of 2014 also stands disposed of accordingly.
