Applicants, who are in jail in connection with FIR no. 106 of 2014, under Sections 379, 411, 420, 483 IPC, registered at police station, Jaspur, District Udham Singh Nagar, have sought their release on bail.
Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.
Initially, an FIR was lodged against unknown thief on 10.06.2014 at police station, Jaspur, for the offence punishable under Section 379 IPC, regarding theft of Pulsar motorcycle. On the very next day, i.e., 11.06.2014, stolen motorcycle was allegedly recovered from the joint possession of the accused persons, including the applicants.
Learned counsel for the applicants submitted that the applicants are in jail since 11.06.2014 and are ready to furnish reliable sureties to the satisfaction of learned Magistrate, if they are granted bail.
Considering the facts and circumstances, a case for bail is made out in favour of the applicants.
Bail application is allowed.
Let the applicants be released on bail on their each executing a personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of CJM, Udham Singh Nagar.
