Applicant Gulzar, who is in jail in connection with Case Crime No. 121 of 2013, Under Section- 395/412 IPC, Police Station Vikas Nagar, District-Dehradun, has sought his release on bail.

Learned counsel for the applicant submitted that the applicant has falsely been implicated in the present crime. He submitted that the applicant is not named in the F.I.R. and he has been arrested only on the basis of suspicion. He submitted that the recovery is planted against the applicant and there is no independent witness of the alleged recovery. He also submitted that the applicant undertakes that if he is released on bail, he will never tamper with the evidence and will remain present before the Court concerned whenever called upon or the case is listed. He lastly submitted that the applicant is languishing in jail since 14.08.2013.

Considering the submissions of learned counsel for the applicant and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage.

The bail application is allowed.

Let the applicant Gulzar be released on bail, on his executing a personal bond and furnishing two sureties, each in the like amount, to the satisfaction of Magistrate concerned.
