This petition has been filed by the petitioner for a direction to the learned Special Judge Anti Corruption, Nainital to send the F.D.R.’s No.0928951, 0928952, 0928953, 0928954, 0928955 to the Court of learned Special Judge Anti Corruption, Lucknow U.P., where the Special Trial No.01 of 2011 and 02 of 2011 are pending.

It is contended by the learned counsel for the petitioner that two trials were pending before the learned Special Judge Anti Corruption, in which petitioner appeared and was enlarged on bail. He submitted that as the petitioner was resident of Lucknow and he has no local sureties, the petitioner furnished five F.D.R.’s. The learned Special Judge/2^nd F.T.C. Nainital accepted the above F.D.R.’s and directed that those F.D.R.’s be kept in Nazarat in original. In the meantime, these two trials were transferred to the Court of learned Special Judge Anti Corruption, Lucknow. Learned counsel for the petitioner prayed that direction may be issued to the learned Special Judge Anti Corruption, Nainital to send the F.D.R.’s No.0928951, 0928952, 0928953, 0928954, 0928955 to the Court of learned Special Judge Anti Corruption, Lucknow

U.P., where the Special Trial No.01 of 2011 and 02 of 2011 are pending.

This prayer is not being opposed by the learned A.G.A. for the State.

Prayer being innocuous is allowed. The writ petition is allowed. Learned Special Judge Anti Corruption, Nainital is directed to send the F.D.R.’s No.0928951, 0928952, 0928953, 0928954, 0928955 to the Court of learned Special Judge Anti Corruption, Lucknow U.P., where the Special Trial No.01 of 2011 and 02 of 2011 are pending.
