Mr. Dinesh Chauhan, learned counsel for the submits that no applicant chargesheet has been filed in the present case within 180 days after the commencement of the judicial custody of the applicant nor any application was ever moved for extension of period for filing the chargesheet as provided under the proviso of Section 36 (A) of N.D.P.S. Act, therefore, he may be permitted to withdraw this application with liberty to file bail application before the Special Judge, N.D.P.S. Act Almora.
Permitted to the withdrawn with the aforesaid liberty.
