This is 3^rd Bail application seeking regular bail in Case Crime No. 246 of 2012 under Sections 392, 411 IPC, Police Station Jwalapur, District Haridwar.

Mr. Manish Arora, Advocate, appearing for the applicant, submits that first and second bail application were dismissed as withdrawn. He further submits that vide order dated 01.07.2013, learned trial court was pleased to frame the charges against the present applicant for the offence punishable under Section 392, 411 IPC and no charge was framed against the present applicant under Section 302 IPC either directly or with the help of Section 34 IPC; applicant is in judicial custody with effect from 24.07.2012; coaccused Monu Mishra @ Prashant, who is charged for the offence punishable under Section 302 IPC as well, has already been enlarged on bail by this Court vide order dated 02.05.2013 (Annexure No.7 to the bail application).

Considering the totality of the facts and circumstances of the case. Bail application is allowed. I direct, let the accused/applicant

be released on bail on furnishing his personal bond of `50,000/- and two sureties of like amount, to the satisfaction of learned Chief Judicial Magistrate, Haridwar.
