Ram Chandra Vs State of Uttarakhand

Applicant‐ Ram Chandra who is in jail in connection with Crime No. 201 of 2012, relating to offences punishable under section 392, 411, 120B IPC, registered at Police Station Ranipur, District Hardwar, has sought his release on bail.

Learned counsel for the applicant submitted that from the perusal of the first information report itself it is clear that the applicant is one of the contractors who were looted by the two miscreants. It is contended that instead of apprehending the real culprits, the police has arrested the present applicant who was with the complainant at the time of robbery committed by the miscreants. Attention of this Court is drawn to the statement of complainant Vinod Kumar Bhandari recorded by the police under section 161 Cr.P.C., in support of above submission.

1. In the above circumstances, without expressing any opinion as to final merits of the case, this Court is of the view that applicant deserves bail.

1. Accordingly, the bail application is allowed. Let applicant Ram Chandra S/o Bhajni be released on bail on executing personal bond, and furnishing two sureties each of the like amount to the satisfaction of the Chief Judicial Magistrate, Hardwar.
