Applicants– Ikram and Babu, who are in jail in connection with F.I.R. No. 471 of 2011, relating to offences punishable under section 147, 148, 149, 336, 436, 427, 153A, 307, 302, 332, and 353 of I.P.C., and one punishable under section 7 of Criminal Law Amendment Act, Police Station Rudrapur, District Udham Singh Nagar, have sought their release on bail.

It is a case of Hindu-Muslim riots. 37 named accused (including Hindus and Muslims) and hundreds of others said to have participated in the incident. There are casualties on both the sides. No specific role has been assigned to anyone. Some twenty co-accused, with similar role, have already been directed to be released on bail.

In the above circumstances, without expressing any opinion as to final merits of the case, this Court is of the view that the applicants deserve bail.

The Bail Application is allowed. Let the applicants- Ikram and Babu, be released on bail on

executing personal bond by each one of them and furnishing two sureties for each one of them, each of the like amount, to the satisfaction of Chief Judicial Magistrate, Udham Singh Nagar.
