Heard Mr. D. Bhattacharji, the learned counsel for the petitioner. No representation from the respondent despite proper service of notice upon him.
The application is for transferring T.S.(Divorce) Case No.59 of 2017 from the file of the learned Judge, Family Court, West Tripura, Agartala to the learned Judge, Family Court, Udaipur, Gomati District.
For the reasons stated in paragraph 8 of the application, it is apparent that the respondent had earlier filed an application for restoration of conjugal rights before the Family Judge, West Tripura, Agartala which was subsequently transferred to the learned Judge, Family Court, Udaipur by the order dated 24-09-2012 on the application of the petitioner. The application was allowed whereupon the case was transferred to Udaipur, Gomati District. From the above facts, the inference is inevitable that it would be more convenient for the petitioner to pursue her case against the respondent at Udaipur rather than at Agartala. In that view of the matter, the ends of justice will be met if the case is transferred to Udaipur, Gomati District.
Resultantly, this transfer petition succeeds. T.S.(Divorce) No.59 of 2017 pending before the learned Judge, Family Court, West Tripura, Agartala stands transferred to the learned Judge, Family Court, Udaipur, Gomati District forthwith . The Family Court, West Tripura, Agartala shall make over the file to the Family Court, Udaipur, Gomati District without unnecessary delay.
The petition is disposed of.
