The instant appeal is directed against the judgment dated 29.08.2014 passed by the learned Civil Judge (Sr. Division), Court No.2, West Tripura, Agartala in Title Suit No.16 of 2014.
It is stated at the Bar that the appeal is covered by the decision rendered by this Court in RFA No.07/2015, RFA No.08/2015 and RFA No.09/2015.
In view of this, the impugned judgment also suffers from illegality, which is hereby set aside.
The suit is remanded to the trial Court for fresh disposal in accordance with law.
The parties are directed to appear before the trial Court on 24.07.2017.
