Heard Mr. P. S. Roy, learned counsel appearing for the appellantapplicant.
This is an application seeking leave to permit the appellantapplicant to withdraw the amount that has been deposited in the Registry by the account payee cheque bearing No.000509 dated 15.11.2017 for an amount of Rs.5,01,052/-.
After scrutiny, this court finds that there is no impediment to permit withdrawal of the amount subject to the observation made by the Commissioner for Employees Compensation in respect of disbursement which reads as under:
Out of the total awarded amount of compensation and the interest, if any, Rs.2,00,000/- (Rupees Two Lakh) shall be kept in a fixed deposit scheme in her name in any nationalized bank for a period of 5(five) years. This amount shall not be withdrawn without prior permission from this Tribunal. The Petitioner is at liberty to withdraw monthly interest over the deposited amount.”
Accordingly this application stands allowed and disposed of.
