This is an application under Section 151 of the Civil Procedure Code for withdrawal of the fixed deposit amount which was deposited as per the order of this Court dated 15.11.2017 passed in I.A. No.02/2017 in MAC Appeal No.10/2017. As, as the fixed deposit amount of the respondent-1 in MAC Appeal No.10/2017 (D/O) has been matured on completion of 5 years, she claims for withdrawal of the said fixed deposit amount.
Prayer of the respondent No.1 (Smt. Rina Sarkar), applicant herein, is
considered.
Accordingly, the instant application is allowed, permitting the applicant (respondent No.1) to withdraw the amount. The Registry shall release the amount as per law observing all formalities.
In view of the above, the present interlocutory application stands allowed and thus disposed of.
