Heard Mr. S. Lodh, the learned counsel for the petitioner. Also heard Mr. S. Sarkar, the learned Public Prosecutor appearing for the State.
This is an application under Section 439 CrPC for granting bail to the accused person, namely, Rajesh Das, who has been detained in custody since 21-07-2017 in connection with Khowai P.S. Case No.2017/KHW/057 U/s 376/417/323 IPC.
It is stated by the learned counsel for the petitioner that the parties have not only come into an amicable settlement of the case, but the accused person has also agreed to marry the victim. In this view of the matter, further detention of the accused person in custody is not warranted.
Resultantly, the accused person shall be released on bail on his executing a P.R. Bond of ` 20,000 /-(Rupees twenty thousand) only with one surety of the like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Khowai.
The application is disposed of.
