Learned counsel, Mr. D.K. Biswas, appearing for the petitioner submits that pursuant to Order dated 07.07.2012 passed in C.M. Application No. 108 of 2012 arising out of L.A. APP No. 28 of 2012, the appellant i.e. the opposite party herein deposited 50% of the awarded amount and the petitioner by filing the present petition prays for allowing the petitioner to withdrawal the amount. Learned counsel, Mr. P. Majumder representing learned Assistant SG submits that the opposite party (appellant) has no objection if the deposited amount is released to the petitioner. In view of the submission of learned counsel of both side, the Registry is directed to make payment of the deposited amount to the petitioner observing the formalities. C.M. application, accordingly, stands disposed of.
