This Writ Petition is I-rled under Article 226 of Constitution

of India seeking the following relief/ s:-

"...to issue a writ order or direction more pa-rticularly in the nature of Writ of Mandamus declaring the inaction of the Respondents in conducting survey and demarcating the boundaries pursuant to the F-line Application No.DER02230O938685 dated 17.O5.2O23 and F-line Application No.DER0225O 1225976 dated 17.1O.2O25 with respect to the Petitioner's land admeasuring Ac.8.37gts in Sy.No. I 1 and Ac. 1 1.34gts in Sy.No.23 total admeasuring and Ac.2O.3 I gts situated at Papireddiguda, Keshampet Mandal, Rangareddy District, as illegal arbitrarjr and violative of Article 14, 79, 2l and 3OO-A of the ConsLitution of India and consequently direct the Respondents to conduct suwey and fix boundaries pursuant to the F-line Application *

Heard the learned counsel for the petitioner and

Sri L.Ravinder, learned Assistant Government plerr ler for Revenue appearing on behalf of respondent Nos. I to 4 and wi h their consent, this writ petition is disposed of at the admission sta11^..

Learned counsel for the petitioner submits I nat he fiied an application to respondent No.3 through Mee-Seva ide application No.DER0223O0938685 dated 17.05.2023 (F-tine application) by paying the requisite fee to conduct a survey and flx l) rundaries of the schedule property. The respondent authorities dic not act on the application even after a lapse of 885 days. Thereafte -, the petitioner fi1ed another application to respondent No.3 throug-t Mee- Seva uide application No.DERO2250 t22S9T6 dated IT.,, t.2025 (F-line application) by paying the requisite fee, but the aut 'rorities did not act even after 45 days. Subsequently, the petitioj rer approached respondent No.4 requesting him to conduct the surr :y, but he took no action. The inaction of the respondents in condl.( ting the survey and fixing the boundaries of the schedule property ; rursualt to the F-line applications dated t7 .O5.2O23 and, tZ .tO i 025 is illegal,

arbitrary, and without reason. Hence, the petitioner filed the present writ petition aggrieved by their inaction.

The issue relating to conduct of survey, demarcation, sub-division of land etc., was considered by this Court vide order dated 23.08.2022 in W.P.No.32785 of 2022 and after taking into consideration the relevant circulars, this Court disposed of the said writ petition with certain directions and the relevant portion of the said order reads as under:-

"8. The Commissioner, Survey, Settlements and Land Records, Hyderabad, has issued various circulars from time to time in connection with conducting of survey, demarcations and subdivision of land and survey numbers and also disposal of F-line petitions submitted by the parties concerned seeking survey and sub-division. The said circulars were issued keeping in view the Board Standing Orders-34A para 2O(a) of the Board Standing Orders, which reads as under:-

'Applications from private parties to point out the boundaries of their fields in accordance with the survey records may be received by the Taluk Tahsildar. On receipt of the application with the deposit (prescribed fee), the Tahsildar should forward it to the Surveyor-Firka Oeputy Surveyor who should, during his visit to the village, comply with the request. The Surveyor-Firka Deputy Surveyor should after pointing out the required boundary to the ryot, obtain his signature to that effect in the application and should himself (write) thereon that the boundary was pointed out by him in accordance with the measurements noted in the survey records."

"F-lrne petitions/demarcation petitions received i , respect of portions of survey fields in agricultural lands should be ( lnverted by Tahsildars ad applications for subdivision on payment cf balance fee payable, if any and subdivision should be done in ac(x rdance with BSO 34-A para 13 and in respect of Telangana districts r accordance with CSSLR circular Rc.No.N1/140gtot dt.13.O7.2007 ."

Thereafter, another Circular in Rc.No.N1/4293 2012 daled 22.08.2012 was issued duly issuing further ins.r rctions and guidelines for demarcation and survey of the sub-d \ sion survey numbers and instruction Nos.1 to 6 of the said Cir: tlar read as under:-

"1 . Every F-Line Demarcation application must b( rubmitted to the concerned Tahsrldar/E Seva/Mee-Seva.

?. Every F-Line Demarcation application must t ) registered

and such registered applications must be attendej in seriatum only and valid reasons for any deviation to the se.i rtum should be recorded.

(a) Every F-Line demarcation applicatiot shall be accompanied by a Xerox copy of pattadar passbool( t a rnpy of the latest adangal/pahani.

(b) Demarcation application without such sL )portive or evidential document may be rejected.

lf the applicant submits a self sworn affidavit < eclaring his rights/reputed ownership a possession alon; with lhe demarcation petition, the concerned Tahsildar rn ry take an appropnate decision after thorough verification of re;ords either to forward the same to the Surveyor or reject.

(a) Mandal Surveyor/Deputy Surveyor shall serv r notices to the

(b) Prior to issue of notices or after issuing the notices, if any written objections of the adjacent land holders are received, demarcation cannot be denied unless it is a legally valid objection and approved by the Tahsildar.

(c) ln general, after issuing the notices if any ad.iacent land holder absent for demarcation, naturally demarcation will be postponed.

¶74

ln such cases, notices to be issued lo all the concerned consequently two times and if any of them is absent for demarcation even after receipt of the notices, a final notice shall be issued rntimating them that the demarcation will be done on the date mentioned in the final notice^"even in their absence", as due opportunity^{was given.}

lf the demarcation application is for a^part of undivided field such application may be converted into^patta subiivision application and necessary statutory^procedure to be followed for it by taking application from applicant."

From a^perusal of the above referred Circulars, it is clear that as and when F-line^petitions for demarcation/sub-division are received in respect of^portions of survey numbers in agricultural land, they are required to be converted as applications for subdivision by the Tahsildars on^payment of balance fee payable, if any and sub{ivision shall be done in respect of the Telangana Districts in accordance with Circular in Rc.No.N'1/1408/07, dated 13.O7 .2007 , issued by the Commissioner of Survey, Settlement and Land Records. At this stage, it would be necessary lo make note of some of the instructions issued in the said Circular dated '|.3.07 .2OO7 which are extracted hereunder:

"5. Thereafter, the Mandal Surveyor will proceed for subdivision and^prepare the sub-division record. The sub{ivision shall be done in accordance with the description of property sale deed in case of sales,^partition deed in case of^partition, mutual agreement in case of succession etc. However, the sub{lvision will be done only

subject to the actual possession on ground tally r I with the documents mentioned above provided that the Tranr;l )rees name finds place in the Revenue accounts through proper mutil on.

After preparation of the SDR, the Mandal {il rveyor shall submit it to the Tahstldar who wll verify whether it cor firms to the documents and whelher records are signed by all t I, concerned parlies. Thereafter, Tahsildar should send the recor(l to Assistant Director, Survey and Land Records Department wilh ir rroposal for sanction of Phodi.

Upon receipt of this proposal, the Assistant I irector shall scrutinize the records and take further action for preparati )n and issue of supplementary sethwar and for incorporalion of change ;, if any,'

11 The Circular instructions issued by the Com 1 rssioner are very clear and absolutely there is no ambiguity and t re obligation that is cast upon the respondent-Tahsildar is un(!( uivocal and hence, any action on the part of the respondents :o refuse to conduct survey and demarcation or sub-dlvision of t, part survey numbers pursuant to the request made by the perscr s concerned by submitting F-Line petitions rs totally impermissiblr and illegal_ It is only to avoid such ambtguous situation, the ab tve referred circulars were issued categorically stating that it is I e obligation on the part of the respondent-Tahsildar to te I -. up such applications as and when the applications are recei( d for survey and demarcation of part survey numbers and to c tmplete the survey by duly collecting the re(uired fees."

In the light of the above, this Court is of th,: considered view that the petitioner herein also stands on the same i oting and she is also entitled for the same relief to maintain parity.

Resultantly, this Writ Petition is disposed ol' ,r ith the following directions:-

if Respondent No.3 is directed to take up the FJine applications of the petitionerp dated 17.O5.2023 and 17.1O.2025 for conducting survey, and hx the boundaries of the subject land admeasuring Ac.8.37gts in Sy.No.1 1 and Ac. I 1.34gts in Sy.No.23 tota.l admeasuring and Ac.2O.31gts siruated at Papireddiguda, Keshampet Mandal, Rangareddy District,

ii) In case respondent No.3 is of the view that sub-division numbers are required to be done and any further fee is required to be paid by the petitioner in terms of the Circulars referred to above, the same shall be intimated to the petitioner and on receipt of such intimation, the petitioner shall pay such lee as may be required by respondent No.3.

iii) On such payment of fee by the petitioner, respondent No.3 shall take further steps for conducting survey as requested by the petitioner and conclude the same in accordance with law;

¶94

iv) The entire exercise, as directed above, shall be completed within a period of forty five (45) working days from the date of receipt of a copy of this order.

As a sequel, the miscellaneous petitions, if any, pending in this

writ petition shall stand closed. No order as to costs.
