This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, 1908, by the petitioner to transfer O.S. No. 34 of 2024 pending on the file of the learned Senior Civil Judge-cum-Assistant Sessions Judge, Ranga Reddy District at Kukatpally, to the file of the learned VI Additional District Court, Ranga Reddy District at Kukatpally for the purpose of conducting trial along with the connected matter uiz., O.S. No. 55 of 2024.

Heard Mr. K.V.Bhanu Prasad, learneci counsel on behatf of Mr. Kothapatti sai sri Harsha, learned counsel for the petitioner and Mr. Mohd Nisar Ahmed, learned counsel for the respondents. Perused the record.

'Ihe subject matter property in both the suits i.e., O.S. I{os. 34 and 55 of 2024 is plot No.l8l in Survey No.15(i admeasuring 5oo sq.yds., situated at Gopanpaily Village, Serilingampally Mandal and I\4unicipality, Ranga Reddy District. The parties to both the suits are arso the sa.me. lrurther, both the respective parties are seeking retief of decleLration of title and perpetual injunction,

Since the parties to the suit, the subject matter and the relir:f sought are similar, trial of both the suits before two different courts may result in delivering'of conflicting decisions apart from resulting in duplication of evidence.

Lezrrned counsel for the respondents reported no objection to allow the Transfer Civil Miscellaneous Petition.

Hence, to avoid duplication of evidence, delivering of conflicting of decisions and multiplication of proceedings, the relief sought for is granted.

In the result, the Transfer Civil Miscellaneous Petition is allowed. The O.S. No. 34 of 2024 stands transferred from the file of learned Senior Civil Judge-cum-Assistant Sessions Judge, Ranga Reddy District at Kukatpally, to the file of the learned VI Additional District Court, Ranga Reddy District at Kukatpally. The Court concerned is hereby directed to transmit the entire case file relating to O.S. No. 34 of 2024, after duly indexed, within a period of one (O1) month from the date of receipt of a copy of this Order, under intimation to the other side. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this petition, shall stand closed.
