This Criminal Petition is filed under Section t;i 8 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seekinll to quash the proceedings against the petitioners/accused lr r s.2 & 3 in C.C.No.5088 of 2020, on the file of the learned XV r,dditional Chief Metropolitan Magistrate, Hyderabad, registered fo the offences punishable under Sections 498-4 and 406 IPC and Silsfisns 4 & 6 of Dowry Prohibition Act

When the matter is taken up for hearing, learned counsel for the petitioners has limited his prayer seeking a direction to dispense with the appearance of the petitioners before the Trial Court.

The learned Additional Public Prosecutor submitted that appropriate orders may be passed.

Perused the record. C.C.No.5088 of 2O2O is pending on the file of the learned XV Additional Chief Metropolitan Magistrate, Hyderabad. Considering the submissions made by both parties and in view of the facts and circumstances of the case, it is deemed appropriate to dispose of the Criminal Petition by dispensing with the appearance of the petitioners before the Trial Court.

Hence, the Criminal Petition is disposed of dispensing with the presence of the petitioners/accused Nos.2 & 3 before the Trial Court provided that the petitioners are represented through an Advocate on every date of hearing and that they shall be present before the Trial Court whenever their presence is specifically required during the course of trial.
