This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Sumksha Sanhita (BNSS), 2023 seeking to quash the proceedings in FIR No.43 of 2025 on the file of Station House Officer, RGI Airport Police Station.

allegations of forgery do not attract against the petitioner herein. Learned counsel for the petitioner further submitted and that once the offence of Section 338 of Bharatiya Nyaya Sanhitha is kept aside, all the other offences are punishabte with imprisonment of less than seven (oZ) years. Hence, prayed to grant the relief of issuance of notice under Section 35(3) of Bharatiya Nagarik suraksha sanhitha, 2023 in favour of the petitioner herein.

Learned Additional Public Prosecutor has submitted that the petitioner herein are facing allegations that accused No.1 has forged the insurance policies and all the other persons, including the petitioner herein worked along with the accused No.1. Thus, the learned Additional Public Prosecutor opposed the submissions of the learned counsel for the petitioner.

5. Perused the record

The contents of the compliant disclose that one Mohd Awyes, has forged the policy document pertaining to an insurance policy and committed fraud with a wrongful intention, thereby resulting in a wrongful gain to them and causing wrongful loss to the company. The complainant is the authorised signatory of Reliance General tnsurance Company. Thus, a perusal of the complaint does not refer to the name of the

petitioner herrein. The investigation is^{still in progress. When there is no} allegation against the^{petitionerwith regard to the alleged forgery of the} lnsurance F)olicy,^{Section 338 of BNS does not attractagainst the} petitioner.
