This Criminal Petition is filed under Section 528 Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/accused No.1 seeking to quash the proceedings against hirn in C.C.No.4716 of 2024 on the file of learned lll Additional Junior Civil Judge-cum-lll Additional Judicial Magistrate of First Class, Ranga Reddy at L.B.Nagar.

Heard Sri Thimmaraju Ramachander Rao, learned. counsel for petitioner and Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-

i-earned counsel for the petitioner submitted that the petitioner is a resident of canada and that he has never harassed the de facto complainant at any point of time. The present complaint has been lodged as an afterthought, solely with an intenti<ln to harass the petitioner herein. He further submitted that the per:itioner neither accepted any dowry at the time of marriage nor dermanded any dowry as alleged by the de facto complainant. It was also submitted that the petitioner apprehends arrest upon his arrival in lndia merely because the cc is pending before the trial Cc'urt.

l-earned Additional Public Prosecutor submitted that the contenls of the complaint point out the allegations under Sections 498-4 and 506 of IPC and section 4 of DP Act and that the police have c,rllected ample evidence during the course of investigation to subs,tantiate the said offences against the petitioner herein. He further submitted that the petitioner is the husband of the de facto complainant. He, therefore, prayed to dismiss the petition.

F)erused the record. The contents of the complaint and the recitals of the charge sheet point out the allegations for the offences under sections 498-A and 50G of IPC and section 4 of rlp Rct lt is alleged that the petitioner used to demand additional \

dowry from the de facto complainant alleged that she has not brought any dowry at the time of marriage and there^{is no returns} which come to his family or himself in marrying her and she does not look beautiful and he therefore commented on her appearance and further has abused her. Hence, prima facie allegations point out the offences against the^petitioner herein. Therefore, there are no grounds to^quash the^proceedings against the petitioner. Hence, this Court deems it appropriate to dispense with the presence of the petitioner before the trial Court.

Accordingly, this Crimina! Petition is disposed of dispensing with the presence of the petitioner before the trial court^provided that he is represented by a counsel before the trial court on every date of hearing and shall appear before the trial court whenever his presence is required during the course of trial.
