Petition under Article 226 ol the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue Writ of Mandamus declaring the action of Respondents in not conductrng the DPC for effecting promotions to the post of Executive Engineer from the cadre of Deputy Executive Engineer TWD despite final seniority list was drawn the Respondents vide Memo No. A3/EstVseniority/Dy EEsl273t2O23 dated 2310112025 and delaying the prornotinns process to the post of Executive Engineer from the post of Deputy Executive Engineer in TWD as being arbitrary and illegat violative of Articles^'14, 16 and 21 of the Constitution of lndia consequently direct the Respondents to forthwith DPC enabling the promotion of the Petitioner

Heard Sri CH. Samson Babu, learned counsel^{for the} petitioner, and learned Government Pleader for Services-Ill^for respondent Nos.l and 2. Perused the^{material on record.}

Learned counsel for the^petitioner submits that^{the petitioner} challenges the delay by the^respondents' in^{conductingthe} Departmental Promotion Committee^{(DPC)for promotionsto the} post of Executive Engineer from the cadre of Deputy Executive Engineer, despite the final seniority list being^{communicatedon} 23.O1.2025. The petitioner. who is ranked at Sl.No.27^{in the} seniority list, is eligrble for^promotion to^one of^{the postsreserved} for Diploma Engineers. Therefore, the^{petitioner made a} representation to respondent No.1 on 15'02.2025,^{seeking to} conduct DPC forthwith and^{considerthe case for promotionto the} post of Executive Engineer. But no action has been^taken. The petitioner is^going to retire on 28.02.2025^{on attaining the age} of superannuation, and the delay^{wouldcause irreparableloss to his} career and^pension. Aggrieved^{by the same, the petitionerhas filed} tne present writ^petition

Learned counsel for the petitioner submits that the appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 15.02.2025 and pass appropriate orders in accordance with law.

Learned Standing Counsel for the respondents did not dispute the submissions made by the learned ccunsel for the petitioner.

Taking into consideratton the submission made by learned counsel for the petitioner, without going into the merits of the case, this Writ Petition is disposed oF directing respondent No.1 to consider the petitioner,s representation dated 15.02.2025 and pass appropriate orders in accordance with rdw, as expeditiousry as possible, preferabry, within a period oF four (4) weeks from the date of receipt of a copy of this order_ There shall be no order as to costs.
