3' Brief facts as stated in the writ petition are that petitioner No. 1 is a devotee of Lord sri Krishna and a member of ISKCON Temple, Hyderabad and after compreting B.Tech in 2006, petitioner No.1 rendered voluntary services at ISKCoN Temple, Hyderabad. Subsequently to continue the distribution of ISKCON literature, a Trust by naJne "vedavani vaibhava seva Trust,, was established by petitioner No.1, respondent No.4 and others. It is submitted that petitioner No.1 functioned as Treasurer, respondent No.4 as secretary, and one Sri Anandamaya prabhuji as President and the Trust functioned prolitably and incentives were paid to full-time functionaries, including petitioner No.l, with the approval of the Managing committee. After disputes arose between the president and respondent No.4 and upon the death of Sri Anandamaya prabhuji on 13-o8-202s, respondent No.4 and his associates took control of the Trust and began

harassing petitioner No.1 alleging that he had misappropriated the Trust funds and demanding Rs.35,00,000/- which allegation is denied by petitioner No.1. Thereafter, on lg-og-2025 respondent No.4 and others forcibly took away the car belonging to the petitioners' family from their residence and from 22-og-2o2s onwards respondent No.3 and his staff repeatedly called and hara$ged the petitioners, demanding payment of the alleged amount and compelling them to come to the police station to settle the dispute. Petitioners' state that the dispute is civil in nature and does not involve any criminal offence and the continued harassment and coercive actions of respondent Nos.3 and 4 are itlegal, arbitrary, and violative of the fundamentat rights of the petitioners. Questioning the s€une, the present writ petition is filed.

Learned Assistant Government^pleader for Home appearing for respondent Nos.1 to 3, on instructions issued by sub-lnspector of Police, Abids police station, Hyderabad, submitted that respondent No.4 had lodged a complaint dated o1.12.2025 before respondent No.3 alleging large-scale financial fraud, criminal breach of trust, forgery and misappropriation of Trust funds against petitioner No.l, who was functioning as

Treasurer of Veda vani vaibhava Seva Trust, in conspiracy with petitioner No.2 and the complainant stated that the Trust registered uide Document No.235 of 2023 and received an amount of about Rs.29.58 lakhs from saie of religious books, which was deposited into the Trust's ICICI Bank account. tt is submitted that during scrutiny, 34 suspicious transactions amounting to Rs.28.91 lakhs were detected, allegedly carried out by petitioner No. 1 using forged signatures and unauthorized net banking access, transferring funds to his personal accounts and to an entity controlled by him. It was further alleged that petitioner No.1 misappropriated rrust books worth over Rs.5.25 lakhs, sold them for cash, and utilized the proceeds for personal purposes including hous.e construction and vehicle purchases in the n€unes of family members. The complainant further stated that petitioner No.l admitted the fraudulent acts on 13.og.2025 and agreed to return money and vehicles and petitioner No.2 gave a written undertaking to repay part of the amount, which was not honoured. As such, prima facie ingredients of cognizable offences were clearly made out. It is further submitted that based on the said complaint, respondent No.3 registered crime No.29g of 2o2s, for the offences punishable under Sections 31g (4) and 316 (21 of BNS, dated ol.12.2o2s, against petitioner Nos.l and 2 and during

the course of investigation, the Investigating officer examined Lw-l, collected relevant documentary evidence including Trust Deed, annexures and bank statements, inspected the scene of o.ffence, conducted observation panchanarna, drew rough sketch and examined other material witnesses and that the investigation is at preliminary stage and for the purpose of investigation, Investigating Officer called the petitioner Nos.1 and 2, who were arrayed as accused Nos.l and 2, to cooperate and to produce documents and expianations. A copy of the F.I.R was annexed to the copy of instructions and has been served to learned counsel for the petitioners.

Learned counsel for the petitioners submits that without issuing any notice, the petitioners were called to the police station and are being harassed.

Per contra, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3, submits that for the purpose of investigation, the petitioners were called, but the petitioners are not cooperating with the investigation.

Recording the submissions of learned counsel on either side, this Writ Petition is disposed of directing the respondent

authorities to follow due procedure as contemplated trnder law for further course of action pursuant to the F.I.R.No.29g of 2o2s dated 01.12.2025 and the petitioners shall cooperate with the investigation in F.l.R.No.298 of 2025.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
