Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue writ or order or orders more particularry in the narure of Mandamus declaring the action of the respondents more particularly the respondent No.2 in refusing to receive, register and release the sate deed presented by the petitioner executed in favour of Dayala Laxmi, in respect of a that house bearing No. 7-5(otd), 1O-1-14113134(new) pTt No. 1041000677, constructed plinth area of 100.0 sft on plot No. 34, in Sy.No. 93, admeasuring 335.0 sq.yds equivalent to 279.09 sq.mtrs, situated at Lingojiguda village, Saroornagar Mandal, R.R.District, under GHMC, L.B Nagar, Cricle-4, Cirile Saroor Nagar, as illegal, unjust and violative of Articles 14, 21 and 300-A of the Constitution of lndia besides violation of principles of natural justice and consequently direct the respondents to receive, register and release the sale deed to the petitioner.

In view of the aforesaid submissions coupled with the provision under Section 7l of the Act, 190g, this Writ Petition is disposed of directing the Registering Authority to receive, register and release the subject document in respect of the subject property, subject to the petitioner complying with the provisions of the Act, 1908 as well as the Indian Stamp Act, 1899. It will be open to the Registering Authority to refuse the document presented before him, if he has any objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner. It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioner to get the subject document registered. There shali be no order as to costs.
