Petition under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in compelling the petitioners to purchase Bisleri water Bottles from a particular distributor nominated by the Corporation at a very higher rate than the market rate and in compelling the petitioners to sell only the water bottles of Bisleri Company and in not permitting the petitioners to sell the water botfles of all recognized companies

in their stalls as per Circular No.4'1l2013 dated 24.09.2013, is highly unjust, unwarranted, irrationial, arbitrary and violative of Articles 14 and 21 of the Constitution of lndia and consequentially direct the respondents to permit the petitioners to sell the water bottles of all recognized companies in their respective stalls as pe,r Circular NO.41l2013 of the Corporation.

Petition under ljection 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 1 and 2 to permit the petitioners 1 to 3 herein to sell the water bottles of all recognized companies in their respective stalls viz; Popcorn Stall and Patanjali Store in Hanamkonda District Bus Station and Popcorn Stall in Hanamkonda Central Bus Station, respectively and directing the respondents 1 and 3 to permit the 4th petitioner herein to sell water bottles of all recorgnised companies in his stall viz; f ea, Coffee and Snacks bearing Stall No.7 in Jubilee Bus Station, Secunderabad, on payment of additional licence fee in accordance with the order of this llonourable Court dated 04.05.2017 passed in W.A.No.5B1 ol 2017 and batch, pending disposal of the above Writ Petition.

Heard Sri C. Ramachandra Raju, learned counsel appearing on behalf of the petitioners and Sri B. Mayur Reddy, learned Standing Counset for TSRTC, appearing on behalf of respondents.

The petitioners approached the Court seeking prayer as under:

" .... to issue an order or direction more in the nature of Writ of Mandamus. declaring the action of the Respondents in compelling the petitioners to purchase Bisleri Water Bottles from a particular distributor nominated by the corporation at a very higher rate than the market rate and in compelling the petitioners to sell only the water bottles of Bisleri Company and in not permitting the petitioners to sell the water bottles of all recognized companies in their stalls as per Circular No.4112013 dated 24.09.2013, is highly unjust, unwarranted, irrational, arbitrary and violative of Articles 74 and 21 of Constitution of India and consequentially direct the respondents to permit the petitioners to sell the water bottles of all recognized companies in their respective stalls as per Circular No.4t/20t3 of the Corporation; and pass...".
