Heard learned counsel for the petitioner and learned Assistant Government Pleader for Prohibition & Excise and learned Assistant Government Pleader for Home.

The petitioner herein is the owner of the subject vehicle i.e., Motor Car (Hyundai i20) bearing registration No.AP 36.{5 8382. In proof ofthe same, she has filed copy of certificate of registration. The subject vehicle was seized in connection with Crime No.75l of 2023 of Subedari Police Station, warangal commissionerate. The petitioner herein is not an accused in the said crime. The allegation leveled against the accused in the said crime is that he was transporting five (05) boxes containing liquor boffles.

on the request made by the petitioner, respondent No.3 has issued proceedings dated 10.05.2024 directing respondent No.4 to give custody of the subject vehicle to the petitioner on her furnishing FDR for an amount of Rs.1,50,000/-. She has already furnished the said FDR and in proof of the same, she has filed copy of bankers

cheque bearing No.972123, dated 04.05.2024. on consideration of the said far:t only, vide proceedings dated 10.05.2024, respondent No.3 directed respondent No.4 to give custody of the subject vehicle. Even then, respondent No.4 is not giving interim custody of the subject vehicle to the petitioner herein. Therefore, challenging the said action of respondent No.4, the petitioner filed the present w,rit petition.

4- whereas, learned Assistant Government pleader fbr Prohibition and Excise has produced copy of confiscaticn order dated 26.03.2024 of respondent No.3.

In the light of the above, this writ petition is disposed of directing r,:spondent No.4 to release the subject vehicle to the petitioner as interim custody on proper rrerification of ownership with original certificate of registration subject to the terms and conditions contained in the proceedings dated 10.05.2024 of respondent No.3 and also further proceedings to be initiated by respondent No.3 pursuant to the confisc;ltion order dated 26.03.2024. In the circumstances of the case, there shall be no order as to costs.
