charge sheet was filed before the learned I Additional Special Judge for SPE and ACB Cases, City Civil Court, Hyderabad uide C.C.No.29 of 2OO8 and uid-e order dated 23.03.2011, the petitioner was found guilty and convicted for the offences alleged against him. Consequently, the petitioner was dismissed from service without any enquiry, by proceedings dated 12.O5.201 1. Aggrieved by the same, the petitioner filed Crl.A.No.379 of 2Oi l before this Court and by order dated O2.O7.2024, the same was,.allowed ald the conviction order dated 23.03.201 1 wag set aside. Further, during the pendency of the aforesaid Criminal Appeal, the petitioner attained age of superannuation on completion of 5g years as of 31.O1.2020. It is further submitted that the petitioner was neither employed nor engaged in any gainful business or venture during the period of suspension or the period he was out of employment. Aggrieved by the conviction in aforesaid C.C., the petitioner filed Crl.A.No.3T9 of 20l1 before this Court. While matter stood thus, the petitioner attained the age of superannuation on 3l.Ol.2O2O. Subsequently, by order dated O2.O2.2O24, this Court acquitted the petitioner from the ACB Case. it is further submitted that in view of interim orders passed by, this Court on O4.1O.2O24, the department sent necessar-v provisional pension proposa-ls on 23.12.2024 to the Accountant General, State of Telangana, who in turn, returned the pension proposals uide letter dated 14.O2.2025 seeking the proceedings relating to the petitioner's reinstatement into service after dismissal and permission to treat him as retiied on 3l .Ol .2O2O. Consequently, the respondents have forwarded letter dated 19.O3.2O25 informing about petitioner,s deemed reinstatement and deemed retirement in pursuance of interim order passed by this Court on O4.1O.2O24. Telangana, on 04.1L2O24, 30.11.2024 and 11.12.2024 inquiring whether any appeal liled before the Honble Supreme Court against the judgment dated O2.O7 .2024 passed by this Court in Cr1.A.No.379 of 2011, however no information has been received frorri the ACB officials so fa_r. Further, the petitioner disabled himself from rendering service on account of his conviction and since he remained out of service, he is not entitied for any benehts or notional seniority. In support of his contentions, Iearned Government Pleader placed reliarrce on the judgments of Hon'ble Supreme Court in Resente Bank of India u. Bhopal Singh Panchala, and Union of India and. others a. Jaipal Singhs.

Having regard to the submissions made by learned counsel for the respective parties and on perusal of record, this Court is of the view that the petitioner was dismissed from service by proceedings dated 12.O5.2O11 consequent to his conviction by the learned Special Court uid"e order dated 23.O3.2071 in C.C.No.29 of 2008. Aggrieved by the same, the petitioner preferred Cr1.A.No.379 of 2011 before this Court.

No.E I a27O I 2024 dated 19.O3.2025, wherein, pursuant to the petitioner's acquitta-l in the ACB case, the issue of deemed reinstatement into service and permission to retire from service was considered by the authorities for the purpose of sanctioning provisional pension uide letter dated 19.03.2O25 In light of the same, and considering the lega1 principles laid down by the Hon'ble Supreme Court in the judgments cited above, this Court is of the view that the impugned order dated 12.O5.2OI1 is not sustainable in law and is liable to be set aside.

Moreover, the record discloses that the petitioner made a representation to respondent No.1 on 24.07 .2024 wherein he requested for grant of consequential benefits. Therefore, this Court is of the opinion that it would be appropriate to direct respondent No. 1 to consider the aforementioned representation and pass appropriate orders in accordance with law.

Accordingly, this writ petition is disposed of setting aside the impugned proceedings No.E/l7SO/20O7 dated 12.05.2011 issued by respondent No.4 and respondent No. i is directed to consider the representation, dated 24.O7.2024, submitted by the petitioner and pass appropriate orders thereon, in the light of lega.l principles laid down by the Hon'ble Supreme Court in B.Jagjeeaan Rco, case (1 supraf and Shobha Ro;m Raturi,s case {2 supra}, strictlv in accordance with law, after a_ffording an opportunity of hearing to the petitioner, as Lxpeditiously as possible, preferably within a period of two (2) months from the date ol. receipt of a copy of this order and communicate a copy thereof to the petitioner. It is made clear that this Court has not expressed arly opinion on the petitioner,s entitlement to specific service or monetary benefits and he is at liberty to pursue further remedies if aggrieved by the decision of the authorities made pursuart to this direction.
