Petition Under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of mandamus declare the inaction of the respondents in conducting the survey and fixing the boundaries by sub division of the subject land in survey No. 162l1t7 extent ac 3.3400 gts situated at Chandrapalle vitlage, Tandur Mandal, Mancherial district in pursuance of the F line application Vide DER022501 194354 dated 20.06.2025 as arbitrary and illegal and violation of principtes of natural justice, and the provisoins of AP survey and boundaries act and consequenfly direct the respondents to conduct the sub division survey of the land and fixing the boundaries of the land in survey No. 1621 1 /2 extent ac 3.3400 gts situated at Chandrapalle village, Tandur Mandal, Mancherial district.

Mr.L.Ravinder, leamed Assistant Government pleader for Revenue appearing for respondent Nos.l to 4.

Petitioner herein is claiming that he is the absolute owner and possessor of land admeasuring Acs.3.j4 guntas in Sy.No.162ll/2, situated at Chandrapalle Village, Tanclur Mandal, Mancherial District, on the strength of registercd sale deed bearing Documenr No.357 of 2021, dated 29. 10.2021. In proof of the same, he filed the copies of latesl. pattadar passbook-cum-title deed and registered sale deed. When the adjacent owners are disputing with regard to the boundaries of the subject property, petitioner has filed F-line application bearing No.DER022501194354, dared 20.0(t.2025 with respondent No.2 with a request to conduct sub-division survey and demarcate the subject properly by fixing the boundaries. application. respondent No.2 did not act upon the same Aggrieved by the said inaction, petitioner filed thc present writ petltloll.

Mr.L.Ravinder. learned Assistant Governurent Pleader fbr Revenuc, on instructions, would submit that respondent No.2 will consider the said F-line application subrnitred by the petitioner and conduct sub-division survey and dornarcate the subject land by fixing thc boundaries, strictly in accordance with law

Vide order dated 23.08.2022 in W.P.No.32185 of 2022, this Court orr considcration of the circulars issued by the Chief Cornmissioncr of Land Adrninistration (CCLA) with regard to conducting sub-division survey, directed the Survey Authoritics to conduct sub-division survey. The /l.s involved in the present writ petition is squarely covered by the aforesaid order.

In thc light of fhc same, this Writ Petition is disposed of with the following directions:

i) Respondent No.2 is directed to take up the F- line application bearing No.DER02250l 194354, dared 20.06.2025 submitted by the petitioner for conducring sub-division survey and demarcation by fixing thc boundaries of the subject land i.e., land admeasuring Acs.3.34 guntas in Sy.No. I 6211/2, situated ar Chandrapalle Village, Tandur Mandal, Mancherial District;

ii) In case, if he is of the view that sub-division of survey numbers is required to be done and any further fees is required to be paid by the petitioner in terms of the circulars referred in the aforesaid order in W.P.No.32785 of 2022, the same shall be intimared to the petitioner and on receipt of such intimation fiom him, the petitioner shall pay such fees as may be required by respondent No.2;

iii) On such payment of fees by the petitioner, lre shall take further steps for taking up the survcy as requested by the petitioner and conclude the sarne in accordance with law by putting all the concemed persons including the neighbours of the subject properties on notice; and

iv) The entire exercise, as directed above, shall be completed within a period of eight (8) weeks rhe date of

receipt ofa copy of this order. There shall be no order as to costs.
