Heard Mr. K. Jamali, leamed counsel for the pedtioner and leamed Assistant Govemment pleader for School Education.

This writ petition is filed to declare the action of respondent Nos.2 and 3 in not considering the representation submitted by the petitioner dated 04.02.2025 requesting them not to accord any permission to establish IAF Creative School at premises bearing Municipal Nos.3_7-2 4, 3_7_25, 3_7_25/1, 3_7_ 25/2, 3-7-25/3 and 3_7_25/4, rotal admeasuring 767.35 square yards, situated at Opposite Old Hospital, Ravindranagar, Mahahubnagar Town and District, as illegal.

The petitioner herein and four (04) others filed a suit in o.s No.35 of 2022 against respondent No.5 herein and others seeking declaration of title and recovery ofpossession and also for cancellation of preliminary decree in o.S. No.3g of 19g7, dated 13.09.1994 etc. The said suit is pending. There are flo interim

In the light of the aforesaid submission, this writ petition is dismissed. However, liberty is granted to the petitioner to submit a representation to the Regional Joint Director, Hyderabad, competent authorif, with a request not to accord permission to respondent No.4 to start school in the subject premises, and it is for the Regional Joint Director to consider the same. In the circumstances of the case, there shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending in the writ petition shall stand closed.
