This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short tsNSS, 2023J seeking quashment of the proceedings in Crime No.468 of 2025 of Vanasthalipuram Police Station, Rachakonda.

The petitioner 1S arrayed as accused in Crime No.468 of 2025 registered for the offences punishable under Sections 316(2), 318(4) r/w 3(5) of BNS

Heard Mr.K.Mahesh Chary, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No. 1 -State.

Learned counsel for the petitioner would submit that though the petitioner is determined to see the process through arrd the alleged offences are punishable with an lmpnsonment up to seven years, the Police concerned have tI,

not issued any notice under Section 35 (3) of BNSS, 2023, as such, the petitioner is apprehending coercive measures against her. He further submits that the petitioner is ready to cooperate with the investigation, hence prayed for necessarJ, directions for issuance of notice as per law.

5 Learned Additional public Prosecutor submits that the Police concemed are ready to issue notice under Section 35 (3) of BNSS, 2023.

7 ' Having regard to the fact that the alreged offences are punishable with an imprisonment up to seven ye.r_rs and as the petitioner/accused is ready to engage herself in tJ.e process, without going into merits of the matter, the Investigating Officer, Vanasthalipuram police Station, Rachakonda is directed to issue notice on the petitioner under Section 35 (3) ot BNSS, 2023, in Crime No.468 of 2025 and take up further proceedings as per the guidelines .of Arnesh Kumar u. State of Bihcrrt scrupulously.
