This Criminal Petition is filed by the pqtitioner/Accused No.1, to quash the proceedings against him in C.C.No. 1425 of 2015, pending on the lile of Additional Judicial Magistrate of First Class-Cum-Il Additional Junior Civil Judge, at Huzurabad.

Heard learned counsel for the petitioner/A- 1 and Sri M.Vivekananda Reddy, learned Assistant public Prosecutor for the respondent - State. Perused the record.

Notice sent to the address of the respondent was returned un-served with an endorsement^.addressee left without instructions'. It does not amount to service of notice.

After arguing for some time, learned counsel for the petitioner confined his prayer to dispense with the personal appearance of petitioner herein- Accused, in the Court below and sought for a direction to the trial Court for early disposal of the case.

Considering the submission of^{learned counselfor the} petitioner, the attendance of petitioner herein is dispensed with, subject to the following conditions:

i) Petitioner herein shall alwa5rs be represented by his counsel on record.

i0 He shall file an affidavit stating that, in his absence, the proceedings conducted by his counsel will not be disputed by him in any manner and shall not dispute his identity also.

iii) He shall appea-r before the learned Magistrate as and when his presence is required. In the event of the^petitioner's failure to appear when the Court directs, this^order dispensing with his attendalce shall stand cancelled.

Since the crime is of the year, 2012, the trial Court is directed to close the evidence of the witnesses, in the event of their non-appearance, and proceed with the trial^and accordingly, dispose of the case within 6 months from^the date of this order.

Accordingly, the Criminal Petition is disposed off.

Miscellaneous applications pending, if any, shall stand closed.
