Petition under Section 483(1) (B) of BNISS praying that in the circumstances stated in the Memorandum of Grounds of Crtiminal Petition, the High Court may be pleased to modify the order and extend the time to comply the order dated 24-07-2025 passed in Crl. M. P. No. 375 ol 2025 dated 24-O7-2025 in Crime No. 752 ol 2024 of PS Nacharam passed by the Principal Diskict and Sessions Judge Court, Medchal Malkajgiri District at Kushaiguda by setting aside the order dated 31-07-2025 passed in Crl.M.P.No.401 of 2O25 in Crl.M.P.No.375 of 2025 in Cr. No. 752 of 2024.

This Petition coming on for hearing; upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri T Chandra Shekar, Advocate for the Petitioner and Sri Arun Kumar Doddla, Additional Public Prosecutor on behalf of Respondent.

This criminal petition is hled by the petitioner/ accused No.2 praying this Court to extend the time grrmted by the Principal District and Sessions Judge Court, Medchal, Malkajgiri, in order dated 24.07 .2025 passed in Crl.MP.No.37 5 of 2025 in crime No.752 of 2024 registered before the Nac earam Police Station.

The brief facts of the case are that by way of order dated 24.O7.2025 passed in Crl.MP.No.375 of 2025 in crime No.752 of 2024, tll.e trial Court granted the relief of anticipatcry bail to the petitioner, directing him to surrender before tlLe concerned Magistrate on or before 2a.O7.2O25 and on such surrender, and on executing personal bond for a sum of Rs.20,0C0/- with two sureties for a like sum to the satisfaction of Additional Junior Civil Judge cum V Additional Judicial Magistrate of First Class, Medchal Malkajgiri, the release of petitioner rvas ordered. Thereafter, the petitioner filed Cr1.MP.No.4O1 of 2025 in Crl.MP.No.375 of 2025 seeking extension of time ibr complying the said order, stating that after hling of anticipatory bail

application, the wife of petitioner, who is aged about 61^years, residing at Jamaica, sustained fracture injury which^required immediate presence of petitioner due to which he left to Jamaica and would arrive to India on 29.Oa.2O25. The^{saidextension} petition was dismissed by the trial Court uide order dated 31.07.2025. Aggrieved thereby, this criminal petition is^filed.

Heard Sri T.Chandra Shekar, learned counsel^for petitioner, and Sri D.Arun Kumar, learned Additional^Public Prosecutor for respondent - State.

l.earned counsel for petitioner submitted that the petitioner went to Jamaica as his wife sustained serious fracture injury which necessitated the prcsence of^petitioner. He^asserted that the peLitioner has no intention to avoid the orders^passed by the trial Court and that by the date of^passing of the earlier orders itself, the petitioner was in Jamaica. Therefore,^prayed this Court to allow this criminal^petition, extending the time granted by the trial Court to surrender before the concerned Magistrate.

On the other hand, the learned Additional Public Prosecutor, vehemently opposed the submissions made by

learned counsel for petitioner and contended that therc are no infirmities or illegalities in the order under challengt: and that the trial Court has rightly dismissed the extension petition.

Having regard to rival submissions made, and on considering the facts and circumstances of the cas;e, this Court deems it fit to allow the Criminal Petition, extenrling the time granted to the petitioner to comply with directions passed by the trial Court in order dated 24.O7.2O25 in Crl.MP.No.375 of 2025 in crime No.752 of 2024.

Accordingly, this Criminal Petition is allowed. directing the petitioner to surrender before the concerned MaEiistrate on or before 15.09.2025 and to comply with the direction:; as passed in order 24.O7.2025 in Crl.MP.No.375 of 2025 in crime No.752 of 2024.
