This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri N.Hari Prasad, Advocate for the Petitioner and the Sri E. Ganesh, Assis{ant Public Prosecutor on behalf of the Respondent No.1 and none appeared for the Respondent No.2.

This criminal petition is filed seeking to quash lt I proceedings in Crime No.395 of 2025 on the file of the Statiorr House Officer, Karimnagar ll Town Police Station, Karimnagar Dishi, t, registered for the offences under Sections 318 (4) of Bharatiya Nyal a Sanhita, 2023 (for short 'BNS') and Sections 3 and 4 of the Telanga ra Protection of Depositors of Financial Establishment Act, 1999 an,l Section 3 read with 4 of the Prize Chits and Money Circular Schem,r ; (Banning) Act, 1978, against the petitioner - accused No.1 .

Heard Mr. N. Hari Prasad, learned c tunsel for the petitioner and Mr.Erigi Ganesh, leamed Assistant Pubti ; Prosecutor for the respondent No.1 -State.

Leamed counsel for the petitioner s I rmits that the petitioner himself is a depositor and that he never colle < ted any amount from the de facto complainant and that he has issuec :heques for his deposit and it was accused No.2, who had collected tl e amount from the depositors and that the petitioner is facing false rrl egations in the present case, and prayed to quash the same.

specifically pointed out that the petitioner herein has collected the amounts from the depositors, and hence prayed to dismiss the petition.

Perused the record.

The offences alleged against the petitioner in the FIR are under Sections 318 (4) of BNS and Sections 3 and 4 of the Telangana Protection of Depositors of Financial Establishment Act, 1999 and Section 3 read with 4 of the Prize Chits and Money Circular Schemes (Banning) Act, 1978. The investigation is still in progress. The police have examined around eight witnesses and recorded their statements. The veracity of the statements of the witnesses and the truth or otherwise of the allegations shall be brought out during the course of investigation and trial, as the case may be.

Hence, the Criminal Petition is disposed of directing the police concemed to complete the investigation strictly in accordance with law and also directing the^petitioner to co-operate with the lnvestigating Agency by furnishing the requisite information and documents as and when required.

Miscellaneous Petitions^pending, if any, shall stand closed.
