Contempt Case No.364 of 2o25

ORDER:

This contempt case is filed under Sections 1 0 to 12 of Contempt of Courts Act, 1g7 I praying to punish the respondents lbr wilfully, deliberately and intentionally violating the orders of this Court order dated 11 .11.2024 in W.P.No.30925 of 2024.

The operative portion of the order dated I 1 .ll .2024 reads as follows:

"8. In uieuL of ttte aboue and tuithout expressing ang opinion on merits of the case, this urit petition is disposed of, directing registering authoitg to consider the registrabilitg of the subject document and pass appropiate orders uithin a period of one (O1) week from the date of receipt of a copg of this order, subject to the petitioners complying with the prouisions of the Indian Registration Ac[ 19O8, and Indian Stamps Act, 1899. k is also open to the Registeing Authoitg to refuse/ receiue the subject document presented before him, if he has any objections, bg duly assigning reasons in support of such decision and communicate the said decision to the petitioners. It is made clear that this order taould not haue ang beaing on all those matters where title/ rights of the

parties are pending before the authorities^eithertn reuision/ appeals for adjudication^{and in any other} case this order also does not^{preclude the parties in} asserting their rights before a^{competent Court of} law. There sholl be no order as lo cosfs."

A counter affidavit^{has beenhled by Tahsildar, Kollapur} Mandal, Nagarkurnooi oistrict^{i.e., respondent herein stating} that as per the orders of this^{Court, the authority has called} both the parties for completing the^{sale deed for registration} process on 16.11.2024 and they^{havebookedslot through} Dharani Application uide No.24OO272244^{dated 78.O5.2024and} both the parties are^present on^{the said date.On the said date,} one Sri Jangam Ramudu along^{with other villagers hasobjected} the said registration stating that^{he has enteredinto agreement} of sale with the petitioner and^{accordingly disputesarose} between the parties and the^{processof registration could not be} completed on the said date. It^{is furthersubmittedthat the said} Jangam Ramudu has filed^{O.S.No. 141 of 2024 on the file of} Senior Civii Judge, Nagarkurnool^{and an ad-interim injunction} has been granted in his favour in^{I.A.No.330of 2024. The said} case is pending for adjudication and^{no counter affidavitis hled'}

Learned counsel for the^{petitionerfairly sutrmits that} petitioners herein are defendant Nos. 1 and^{2 in the above said}

suit in O-S.No.l47 of 2024 on the hle of Senior Civil Judge,

Nagarkurnool which is pending for adjudication.

In vierv of the said disputed questions of fact, this

contempt case cannot be entertained and abcordingly stands

dismissed
