Contemnors/ respondents No.4 & 5 are present before the Courl in-person.

This Contempt Case has been filed by the petitioner alleging non-compliance and willful disobedience to the order of rhis court d1.29.09.2023 in W.p.No.302g7 0f 202t.

Heard lcarned counsel for petitioner, Iearned Government Pleader for Land Acquisition appearing for respondents No.I to 5, ancl perused the record.

Learned Government Pleader for Land Acquisition submits that though initiatly the subject land was allotted to Tribal Welfare Department, since, the said land is now vested with the revenue authorilies, the concerned revenue authorities have initiated land acquisition proceedings by issuing preliminary notification under Section 11(1) of the Act on 23.t2.2024.

Learned Government Pleader further submits that necessary exemption from application of Chapter _ II & III of Right to F air Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 20 13 (for short 'the ActJ have been obtained and preliminary notification was also published in Andhra Jyothi Telugu vernacular newspaper and Indian Express English newspaper on 25.12.2024.

Learned Government pleader further submits that since, the respondents-authorities have initiated land acquisition proceedings, the authorities would take further action by passing an Award, within the time frame prescribed uncier the Act.

7 . I have taken note of lhe aforesaid submissions

Having regard to the submissions made as above, and since, the respondents-authorities have norv initiated action in compliance with the direction of this Couri, dt.2g.Og.2o23 in W.P.No.3O297 of 2021, this Court is of the view that the respondents-authorities have purged themselves of the contempt of the order ol- this Court.

However, respondents-authorities l-raving initiated land acquisition proceedings by issuing preliminary notification under Section 11(1) of the Act, are required to complete the entire process of acquisilion by adhering to the timelines

prescribed under the Act including payment of compensation to the awardee in accordance with the Act.

Subject to the above observations, the Contempt Case is

closed. No order as to costs.
