The^{petitioner claims to be the owner and possessor of the} house^{premises bearing No.16-7-169/1 in sy.No.15/2, situatedat} Girimajipet,^{Warangal' The part of the said land' was acquired by the} respondents^{for the purpose of widening of the road by issuing}

notification under Section 4(1) of the Land AcQuisition Act, 1894 (for short^.the Act, 1894J which was publisheo on 19.01.1987. It is the further case of the petitioner that prior to publication of the notification under Section 4(l) of the Act, 1g94, the respondents have taken possession of the part of the property to an extent of 152 square yards and when the petitioner was denied compensation in accordance with the provisions of the Act 1g94, thepetitioner whs constrained to file writ petition No.g6gg of 2006 before this court. By an order, dated OS.OI.2O|T, this Court while allowing the writ petition directed the respondents to initiate the proceedings under the provisions of the Right to Fair Compensation and Transparencv in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short "the Act, 20 13',1 and pay compensation to the petitioner as per the market value existing as on the date of said fresh notification within a period of four (04) months from the date of receipt of a copy of the said order. Aggrieved by the order, Writ Appeal No. 1119 of 2018 was filed on 18.07.2022 and pending adjudication of the writ appeal, considering the request of the petitioner, the respondents have initiated the proceedings under the provisions of the Act, 2013 and P^{assedanawardUideproceedingsNo.B/812/2o23,dated} to^{arr extent of 152 Sqt'rare Yard.s. lt is ttre} 25.04'2024^{iorthe land}

5 In view of the above submissions and since it is stated that the petition filed under Section 64 of the Act, 2013 has been referred to the Land Acquisition Authority constituted under Section 51 of the Act, 2013 to determine the compensation payable to the petitioner, this Court deems it appropriate to dispose of the Writ Petition directing the competent authority to decide the petition frled under Section 64 of the Act, 2O13 by the petitioner in accordance with the provisions of the Act, 2O13 within a period of four (04) months frorn the date of receipt of a copy of this order
