Aggrieved by the award dated^{10.05.2011in M.V.O.P.No'94 of} 2010 passdd by the Special ]udge^{for trial of offences under SC,/ST} (POA) Act-cum-V Addl. District and^Sessions Judge,^Medakat Sangareddy, the Insurance Company^{has filed MACMA No.2502 of} 2013 questioning their tiability^{and the claimantshave filed MACMA} No.1425 of 2011for enhancement^{of the compensation.}

2 Since both the appeals^{arise out of the verysamefinding in} O.P.No.94 ot201,0, both the appeals^{are disposedof by way of common} judgment.

The claim petition was filed claiming^{compensation of} Rs.6,00,000/- on the death of the^{deceasedin the motor vehicle} accident.

On the basis of the claim^{petition filed, the trial Court having} considered the evidence on record granted^{compensationof} Rs.3,77,@O/ - to be paid to the claimants

The marurer in which the^{accident has taken place is not in} dispute. Further, it is not in dispute^{regarding insurerof the} offending vehicle.

The only ground raised by the learned^{counsel for the} lnsurance company is that towards^{personal accident coverageof the} owner/ driver,^{Rs.100/- was paid. In accordance with the conditions of} the lnsurance policy and also^{the Indian Motor Tariff General} Regulation-36, the coverage of the^{insurancewouldbe Rs.2.00lakhsfor} payment of Rs.100/-. The said^fact is^{not disputed by the leamed} couruel for the claimants.

In view of the rcsbriction imposed^{on grant of compensation} and accepting the said restriction,^{as onlyRs.100/- was paid towards} personal accident coverage,^{the compensationthat can be grantedis} only Rs.2.00lakhs. The trial^{Court has committederror in granting} compensation above the prescribed^limit

In the result, thc MACMA No.2502^{of 2013is partly allowed} and the impugned order^{is modifiedto the extent of compensation} amount to be^paid by^{thc lnsurancecompany. The Insurance comPany}
