Aggrieved by the order dated O8.O7.2022 in I.A.No.725 of 2022 in I.A.No.215 of 2O2L in LA.No.854 of 1984 rn O.S.No.42 of 1962 passed by the Court of learned I Senior Civil Judge, City Civil Court, Hyderabad, the present Civil Revision Petition is filed.

I.A.No.725 of 2022 is filed under Section 151 ol CPC seeking to reject the petition i.e., I.A.No.215 of 2O2l hled by respondent No.1 and in the said I.A., he is respondent No.38. In the said I.A. in paragraph No.2, it is stated that final decree petition I.A.No.854 of 1984 is pending and in fact it is a false statement in which a final decree was passed on O7.O7.2OO5 upon which, appea.ls were preferred before this Court and the sarne were conhrmed by the Honble Supreme Court in Civil Appeal Nos.4731 of 2OlO and. 4732 of 2O1O and the same have become final in respect of item No.6 of B' Schedule property. Once the final decree has attained finality, this Court becomes functus officio and as a limited power under Section I 52 of CPC to correct clerical or arithmetical mistakes in judgments, the petition under Order I Rule I O (2) is not

maintainable arrd it changes the nature of the final decree wherein the petitioner is asking for striking off respondent Nos.3l to 36 in I.A.No.854 of 19g4. The assignees rvho are respondent Nos.3l to 36 are being conhrmed by this Court before passing final decree in I.A.No.3O7 if lggg and I.A.No.3O8 of 1999 and their possession was confirmed by the Hon'ble Supreme Court in Civil Appeal Nos.473 I and 4732 of 2OlO. A preliminary decree was passed in the year 1970. Therefore, the mother did not object the rights of the assignee. Petitioner is claiming his rights from Sri Hasan AIi, who is defendant No.3 in the suit, he also did not object the rights of the assignee during his life time. The petitioner is claiming for adjudication by this Court though it has become functus officio. As such, prayed the Court to reject the petition.

Admittedly, I.A.No.215 of 2O2l is^{filed underSection} 151 of CPC to reject the application.^{Though it is filed under} Section 151 of CPC, rejection^{dealswith Order VII Rule 11 of} CPC. Under Order VII Rule^{1 1} , there are^{specificgrounds} under which plaint can be rejected.^{Though learned counsel} for the revision petitioner submitted that^{Section141 of CPC} says provisions are applicable to the applications^{also. This} Court in C.R.P.Nos.766 and 842^{of 2Ol7 observedthat Order} VII Rule 1 1 does not applies to applications.^{In view of the} subject interlocutory applications, the^{provisionsunder} Section l4l of CPC have no application^{to the instantcase-} The trial Court is^justified in not numbering^{the application.} As such, there is no illegality in the^{order of the trial Court} and there are no merits in the^{petition and it is liable to be} dismissed.
