This writ petition has been filed seeking a Writ of Mandamus declaring the initiation of proceedings with regard to petitioner's House vide L.T.R. Case No. A/7O/46/v2/22, dated 27.1O.2O22 in Form-E by Spl. Deputy Collector (TW), Eturunagaram, / 3'a respondent, as illegal, arbitrary and against the provisions of Telangar-ra Schedulcd Areas Land Transfer Regulation, 1959 as arncnded by Regulation I of 197O and Rules framcd i,hercunder and also in violation of Forrn-E prescribed thereunder and without jurisdiction".

petitioner to submit an explanation within a period of 15 days as to why the petitioner should not be ejected from the said house.

The learned counsel for the petitioner veherrrently contended that the respondent No.3 without mentioning any descriptive particulars of the property as required under Rule 7 (1) & (2) of Rules, issued the cryptic notice and the same is contrary to the Regulations and Rules.

In support of his contention he relied on the judgment of this Court passed in W.P.No.31064 of 2012, dated 29.O3.2O23.

Per contra, learned Assistant Government Pleader for Social Welfare submits that respondcnt No.3 after following the due procedure as prescribed under the Regulations and Rules issued the impugncd Notice dated 27.IO.2022 ald when the petitioner failed ro subrnit the explanation within time, pursuant to the impugned Notice, respondent No.3 issucd another issued on 22.02.2023 directing the pctitioner to appear before the respondent No.3 on 1O.03.2023.
