In this batch of writ petitions, the proceedings. issued by thc respondent No.2 under Sections B(r), S(4), 10(1). 1O(3), 10(5) and 10(6) of the Urban Land Ceiting (Regulation) Act, 1976 in respect of File No.H1z'2710/200€ dated 16.03.2007, have been challenged ccntending that the proceedings were issued in the name of a dead person, namely, Hyder Ali Mirza.

Heard Mr. E. Ajay Reddy, learned senior counsel for the Petitioners and Mr. Harender^pershad, learned Spccial Governmcnt Pleader.

Lea!-ned counsel for the petitioners submitted that the issue, rnvolved in this barch of writ petitions, is squarely covered by the common order dated 21.04.2015 in Wp.Nos.16715 and 17160 of 2009 wherein it was held as under:

To take compulsory posses t'on under sect'cn 10(6) of the Act 1976, the persons who u.. ,n must be put on notice. The proceedings under various provisions of the Act 1976 were taken out treating Hyder Ali Mi.za as owner, whereas by 19g2 itself he sold several extents of land originally owned by him and ceased to be owner to the extent of land sold by him. Thus, by the tirne the Repeating Act came into force, the property has not vest and, thererore, a, the proceedines under the ^.,^{,r;t::?:."ttate}

Pleader fairly contended that 17160 of 2009 is Hyder Ali

the declarant in Wp.Nos.1671S and

Mirza and the impugned proceedings therein were set side by recording a finding that Hyder Ali Miza expired by the time proceedings under the 1976 Act commenced. The appeals filed by the State Government in WA.Nos.7O. 76, Slg and S39 of 2019 have been dismissed as withdrawn on 0g.O3.2022. Copy of the said order is placed on record. Later, the review application in Review IA.No.1 of 2022 in WP.Nos.t6715 and 17160 of 2009, filed by the State challenging the order dated 2L.O4.2015, uras dismissed vide order dated 02.12.20O2.

Learned senior counsel for the petitioners has drawn the attention of this Court to the report of the Enquiry Officer dated 02.09.2006.

I have perused the said report dated 02.09.2006. The names of the writ petitioners have been recorded as occupiei.s in the said report along with the names of petitioners in Wp.Nos.16715 and 17160 of 2009. As per the said reoort, Hyder Ali Mirza sold the land admeasuring Ac.3.18 guntas in Sy.tio.49lle9 and Ac.1.OO guntas in Sy.No.49l/er (Ac.4.18 guntas in Manchirevula village) to Swastik Cooperative House Building Society Limited under registered sale deed dated bearing document No.8276/1992. According to the enquiry officer, the declarant Hyder Ali Mirza violated conditions of Section 2(O) certificate by selling the same to individual persons.

It was also mentioned that flyder Ati Mirza obtained Section 2(O) certificate No.C5l107l 1982 dated 06.08.1982 for total extent -of Ac.50.03 guntas of Manchirevula Village comprising of several survey numbers including Sy.No./i91le9, e9.

As noted above, the report dated 02.09.2006 was also considered by learned Single Judge of this Court in Wp.Nos.167ls and 17160 of 2009 dated 21.04.2015 wherein ir was held by this Court that the names of the petitioners therein were reflected in the revenue records and they were in possession and enjoyment land in question and were treated as pattadars and that they were entitled to notice and opportunity before final statement and before taking proceedings under Section 10 oF the Act. Further, rt was recorcied, as extracted above in para 3, that these proceedings are liable to be set aside on this sole ground and as no opportunity of hearing was given to the petitioners before finalization of the proceedings under the Act.

Thus. it is submittect by the learned senior counsel for the petitioners that the petitiolers har-,^ "-^:: .:,''or ners herein are similarly plaaed as that of the petitioners in Wp. No s.16715 and 17160 of 2009. The said statement is not disputed by the learned Special Government Pleader. However, the learned Special Government pleader submitted that the relief, if any, granted to the petitioners may be

In view of the above, the u/rit petitions are allowed. The impugned proceedings, issued in respect of the lands of the petitioners viz. Ac.1.48.5 cents in Sy.t'Jo.478(P), 483(P), 485(P), 486(P) and 491(P) in WP.No.4998 of 20O9; Ac.2.18 guntas in Sy.No.a78(P), 483(P), 485(P), 486(P) and 491(P) in WP.No.4999 of 2009; Ac.0.39 guntas (Ac.0.15 guntas of petitioner No.1 and Ac.0.24 guntas of petitioners No.2 to 6 in Sy.No.478(P), 483(P), 48a(P) and a85(P) in WP.No.5004 of 2009; Ac.O.22 guntas in Sy.No.478 in WP.No.5005 of 2009 and Ac.0.39 guntas in Sy.No.478(P), 483(P), 484(P) and 43s(P) in wP.No.5006 of 20o9, Manchirevula Village, Rajendranagar' tlandal, Ranga Reddy District, are set aside insofar as the petitioners are concerned.
