This Writ Petition is filed by twenty (20) petitioners questioning the draft declaration published under Section 19(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2O 13 ("the Act, 2013" for brevity) vide file No.Gl/ 1638 /2O2O dated 06.12.2022 published on 70.72.2022 in respect of the subject plots by notifying the same in the name of the Iifth respondent as pattadar of the land in Survey Nos. 198, 199 and 2OO oI Rejinthal Village, Nyalkal Mandal, Sanga Reddy District, as illegal and arbitrary.

It is the case of the petitioners that all the petitioners have purchased the subject plots under various registered sale deeds from the fifth respondent and the entire land in Survey Nos.l98, 199 and 2O0 was converted as plots long back. In spite of the same, the respondents, while proposing to acquire the land in the said survey numbers, have notified the name of the fifth respondent as the owner of the said extent of land ignoring the registered sale deeds executed by the fifttr respondent in favour of the petitioners herein.

When the matter is taken up lor consideration, learned Assistant Government Pleader placed before this Court the written instructions received from the third respondent, wherein it is stated that the fifth respondent hcrein submitted a petition dated 23.01.2023 stating that he has sold the subject^plots to the petitioners on various dates and he has no objection whatsoever for grant of compensation in favour of the petitioners in respect of the said plots situated in Survey Nos. 198, 199 and 2OO of Rejinthal Village. Relevant portion from the written instructions reads as under:-

"[t is submitted that Sri N.Sambashiva Rao, Respondent No.5 herein has submitted a petition in this oflice on'23.O1.2023 stating that he has sold the subject plots mentioned in the petitioner to the petitioners on various dates vide various sale deeds. He is having no objection whatsoever for granting the award of compensation in land acquisition in Sy.Nos. 198, 199 and 200 in Village Rejinthal, Nyalkal Mandal, Sangareddy District to these petitioners after verifying their credentials and claims and also stated that he would ful1y co-operate and willing to sing any documentation that ma1' be required in this regards to ensure that they get their compensation to the extent of their plot holding."

In the light of the above, there is no necessity to further examine the matter on merits and the Writ Petition can be disposed of at the admission stage without inviting counter. 5. Accordingly, the Writ Petition is disposed of directing the third respondent to consider the claim of the petitioners for

payment of compensation in respect of their respective plots being claimed by the petitioners after verifying their documents and take into consideration the claim of the petitioner while passing award pursuant to the declaration under Section 19(1) of the Act, 2013, vide file No.G1l1638/2O2O dated 06.12.2022. Petitioners are granted liberty to submit a fresh representation/claim before the third respondent within a period of two weeks from the date of receipt of a copy of this order.

There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed.
