Insofirr as thc monetary compensation awarded in respect of thc land in Sy.No.45 I admeasuring Ac.0.07 gts., is concerncd, thc requesL of thc petitioner for allotment of Developed iand in tcrms cf G.O.Ms.No.36, dated 22.O1.2O11, was considered by respondent No.2 and a consent award was passed in PLC No.2i/2015, dated 24.08.2015. As no compensation was awarded in respect of the land admeasuring Ac.O-19.27 gts., in Sy.No.452, the petitioner approached this Court questioning the award, dated 26.O7.2013, by frling W.P.No.24479 of 2015.

Demand Drafls bcaring Nos.795184 anci 795I9O, daLed 15.02.2006, is claiming the right title and possession over the subject land. Thus, it is tl-re case o[ the petitioner that the subject land though declared to be a surplus land, the same was allotted in accordance with law in favour o[ the petitioner, respondent No.2 erroneously failcd to takc note of the said fact and refused to pay compensation in favour of the petitioner in respect of the subject land. Thus, it is contended [hat the action of respondent No.2 in passing nil au,ard in rcspect of the subject land is totaily arbitrary ancl violer⁽ ive of Articles 14 and 3OOA of the Constitution o[ India.

In the entire counter affidavit filed by respondent No.2, the factual aspects referred to hercinabove are not disputed. The only contention that is raised by respondent No.2 in the counter afhdavit is that the pctitioner lailed to participate in the award enquiry before respondent No.2 and failed to bring it to the notice of respondent No.2 about G.O.Ms.No.149i, dated O1.|2.2OOZ and about the allotment of the land in favour of the petitioner herein. time in between, this Court is r.rf the considered view that it is a fit case where this Court should exercise its discretion under Article 226 of the Constitution of India and accordingly it is declared that tl-rc pctitioner is entitled for payment of compensation in rcspect of the subject land admeasuring Ac.O- 19.27 gts., situated in Sy.No.452 or for allotment of land in terms of G.O.Ms.No.36, datcd 22.O1.2011 on par with the other land owners and in thc. sirnilar lines as the allotment of land granted in favour oi the pelitioner in respect of the land situated in Sy. No.45 1 .

During pcndencl, of W.p_No.24479 of 2O15, when developed land is being trllotted in favour of the respective land owners, thc petitioncr approached this Court by filing W.P.No.43865 ot 2016 and this Court, by an order, dated 20.12.2016 passed an intcrim order directing the respondents to maintain status quo as regards allotment of a plot covered by the subject mattcr o[ the said writ petition. The said interim order is still in operativc, and the said Writ petition is also being disposed of by th is common order.
