As per the information providcd to the petitioner under the Right to Inlormation Act, 2006, notice under Section 10(5) of the Act, 1976 was issued to Mr'. M.L. Srinivasa Rao dated 23.02.2006. Notice shows that ('.('.No.G lll843ll976 pertains to M.N. Lakshmi Narsaiah but not N4.1.. Srinivasa Rao. According to leamed counsel lor the petitioners, notices have been fabricated. There is no notice issued to late Mr. M.N. Lakshmi Narsaiah under Section I0(5) olthe Act, It rclation to C.C.No.Gl1184311976. Late Mr. M.N. Lakshmi Narsaiah died on 10.01.1994 and notice issued to Mr. M.L Srirrirasa ltao describes him as son olMr. M.L. Lakshmi Narsaiah. It is contended that with a malafide intention notice \vas issued to Mr. Ivl.L. Srinivasa Rao showing the case number ol latc Mr. M.N. Lakshmi Narsaiah. Subsequently, panchanama is allcged to have becn conclucted on 14.03.2008, and the alleged pancltananra lc'por1 tlatcd I^-1.0--i.2008 is a fabricated one. 7 . Learned counsel for the petitioners submitted that land o1'the declarants - vcndors of the petitioners is situated in tbur^(l) villages i.e., Alwal, Dammaiguda, Jeedimetla and Kapra. As per the panchanama dated 14.03.2008 alleged posscssion olthe surplus land was taken in respect of the lands in AIrval, Dammaiguda^and Jeedimetla but not Kapra village. It is further submitted that the panchanama repoft does not show the Survey Nos.562. 588, -;9 l. 595 and 596.

[ven il Survey Nos.591, 595 and 596 rvere omitted in thc panchanarna, the same will not create title to the petitioners as the surplus land was computed under Sections 8(4), l0(5)and l0(6) ol-the Act, 1976.
