This Writ Petition is filcd secking a writ ol Mandamus lo direct the respondents to forthu'tth (lel)lsit the decretal amount in favour of the petitioners i.e., an arnount of Rs.2,11,87,O7 5/- with interest from thc datc of E.P.No,7 of 2023 in L.A.O.P.No.5 of 2OO4 to the credrt r;f szricl E.P. rrs per Lhc decree, daLed 77.O9.2014 in L.A.O.P.No.5 ol 200.1 orr rhe filc of Senior Civil Judge, Peddapalli.

As can be seen from the record, notificalior under Section 4(1) of the Land Acquisition Acr, 1894 (for short, 'the Act, 1894'), was issued way back on 29.7O.1998 and r.hereafter, respondent No.2 passed Award granling compcnsation in favour of the petitioners in category-wise. Not satisfred u,iLh the said compensation awarded by respondent No.2, the pctitioners sought reference under Section 18 of thc Act, 1894 to tlre Civil Court and the same was numbered as L.A.O.P.No.5 ol 2r)04 on the hle of Senior Civil Judge, Peddapalli, Bv an orclcr. dated

17 .O9.2014 in L.A.O-P.No.5 of 2OO4, the Relerence Court enhanced the compcnsation arvarded bl respondent No.2. Howcver, the State^(iovernment has prcferred an appeal in L.A.A.S.No.141 of 2Ol l, dated 23.O2.2O11 and the said appeal was remitted back to the Rcference Court to hear the benehciaries and pass appropriatc ordcrs afresh. As per the directions of this Court, the relcrence Court disposed of said L.A.O.P.No.S of 2Ol4 on 17 .O9.2O14. [t is stated that the petitioners herein havc not filed any appeal against the order and decree passcd in the said L.A.O.P.No.S of 2014, but some of the claimants have filed L.A.A.S.No. 193 of 20 15 and the same is pending before this Court. In thc said appeal, the respondents have not hled any cross objections. Therefore, the petitioners filed E.P.No.7 of 2023 on the file of Court of Senior Civil Judge, Godhavarikhani, and the same is pending. It is stated that as per the order and decree passed in O.P.No.S of 2004, the respondents have to deposit the decretal amount to the credit of E.P.No.7 of 2023. But, without paying the compensation, the E.P. is being adjourned from time to time.

Having regard to the abovc backdrop of r.tc casc, this Court is of the considered view that the authorirics cannot take their own time to deposit the amounts vr.hich r rre n lreadr, enhanced by the competent Court. Thc inaction oI thc respondents in paying the enhanced compensation alnolrrlts in time to the petitioners, who are already sufferrng frorn the Ioss of their lands, would make them to also suffer untolci h:rrdship and misery and run from pillar to post for getting the en tanccd compensation deposited and incur expenses for the same. They will also have to incur additional expenditurc for approaching the Court for seeking the required relief. With the rising inflation, the value of the money will also go down and the delayed payment of the enhanced compensation will res;ult in the compensation amount itself losing all the charm and utility. If the petitioners or similarty situatecl persons receive the enhanced compensation within the time, they rvill bc in a

position to use that amount in some othcr investments and get somc returns over thc same.

Having regard to the samc, the Writ Petrtion is disposed of and respondent No.2 is directed to deposit the enhanced compensation amount, in terms of thc order and decree, dated 17.O9.2014, in L.A.O.P-No.OS of 2OO4 passed by the learned Senior Civil Judgc, Peddapalli, to the credit of E.P.No.O7 of 2023 in L.A.O.P.No.O5 of 004 on the file of the Senior Civil Judge, Godhavankhani, as expeditiously as possible, at any rate, within a period ol three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.
