However, it is brought to the notice of this Court that after Iiling of this revision, the petitioner/defendant has Iiied counter affidavit along with an affidavit to advance the said I.A.No.1051 of 2O23 and the same is now posted to OS.O9.2O23.

In view of the same, the civii revision petition is disposed of permitting the petitioner/defendant to contest I.A.No.105l of 2023 in O.S.No.275 of 2023 on the file of the Junior Civil Judge at Zaheerabad, and the trial Court is requested to dispose of the said application on merits, as expeditiously as possible, at any rate on or before 21.09.2023. There shail be no order as to costs.
