Petition under Article 226 ol the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ of Mandamus or any other appropriate writ declaring that the Waqf Gazette Notification of the 1. "lt is also to be noted in this regard [har though the Wakf Board has been contending that the property in qucstion is a wakf property, which was notihed in the Olficial GazeLte as early as in 1989, but it is surprising to note that till today no action has been initiated either for cvictir-rg the petitioners or for recovery o[ possession of the u,akf property and no proceedings were initiated belore thc Tribunai cons[ituted under the Act. None of the revenue records even whisper about the property as belonging t-o Wakf Board. It appears that the Wakf Board has liled an appeal only against the order of granting occupancy rights to the petitioners, and that too after one and half decades which is pending before the appellate authorit5z on which I am not inclined to make any comments. Under these circumstances, I have to necessarily hold that the notification published by the Wakf Board in the Gazette on 9-2-1989 is not valid and the same is not binding on the petitioners. Accordingly, it is set aside as lar as the petitioners are concerned. So far as the relief for quashing the proceedings pending before the appellate authorify under the Inams Abolition Act is concerned, I am not inclined to do so. It is open lor the parties to agitate their respective rights before the appropriate authority."

On the other hand, the submission of^{the learned} Standing Counsel for the^{Waqf Board is that though the} notification dated 09.02.1989^{was set asideby this Court, in} view of the change of law, more^{particularly,the subsequent} amendments to the^{Waqf Act, 1995,which were carried out} through Amendment Act 47 of^{2O13 with effect from} O 1.01.2O 13, the subject^{propertyisprohibitedfor} registration.
