He further stated that he had preferred appeal vrde R.A.No.5-5 ol' 2009 on the file of Chief Judgc, City Small Causes Courr, Hyderabad ancl the same was pending. The plaintiff also filed cross appeal in R.A.No,67 o1'2007. He also admitted the filing of O.S. No.207 of2006 lor specilrc perfonnance oforal agreement of sale on the file of X Additional Chief .ludge (FTC) Hyderabad. He stated that during the pendency of O.S.No.3430 o12003 the plaintiff offered to sell the suit shops to the defendant and hrs wifc Smt. Saraswathi Devi and his brother's wife Smt. Pushpa Devi and they entered into an oral agreement of sale for a consideration ol Rs.7,87,500/- tbr each shop on 819-07-2003. They paid an amount of Rs.65,000/- on the santc day in the presence of witnesses on the conditions that, the rjefendant \,as not required to pay the tent from May 2003 onwards; the ptaintiff has to obtain NOC from the bank, with which the suit shops were mortgaged; thc ptainti li has to take steps to mutate the suit shops in the municipal reccrd, in his naurc as the property stands in the name of his mother; time rvas not cssence of contract and the deposit amount of Rs.6,00,000/- would be deducted llom the balance sale consideration of Rs 15,75,000/-.
